Class Action Lawsuit Over Facebook Biometrics to Proceed

The feature is alleged to infringe upon IL law, with the state being one of only a select few that have established privacy protections for citizens' biometric data.

A federal judge has ruled that a class action lawsuit including millions of Facebook users can proceed with their claims that the social media firm violated an IL law relating to the collection and storage of biometric data without users consent, according to Bloomberg. Among others, the company says its photo-tagging feature isn't covered by the IL law, because Facebook doesn't have servers in IL. The lawsuit says this breaches IL state law. But despite Facebook's success in getting the case moved from IL to San Francisco, the judge ruled that "plaintiffs' claims are sufficiently cohesive to allow for a fair and efficient resolution on a class basis".

The ruling, issued Monday, authorizes a class of "Facebook users located in IL for whom Facebook created and stored a face template after June 7, 2011".

The decision comes days after Facebook chief executive Mark Zuckerberg faced intensive questioning by United States lawmakers over the company's collection and use of user data.

Facebook also unsuccessfully contended that the consumers shouldn't be able to proceed as a class for numerous reasons, including that any injuries to consumers require individual determinations.

In the case before Donato, he has ruled that the IL law is clear: Facebook has collected a "wealth of data on its users, including self-reported residency and IP addresses".

Facebook has stated that they are reviewing the ruling saying, "We continue to believe the case has no merit and will defend ourselves vigorously".


What does the facial recognition do?

The feature suggests who might be present in uploaded photos, based on an existing database of faces.

Following a successful test in December 2010, the function rolled out worldwide the next summer, making it easier for users to tag Facebook friends in photos.

"If you've never been tagged in a photo on Facebook or have untagged yourself in all photos of you on Facebook, then we do not have this summary information for you", the company says.

The facial recognition feature isn't now available in the UK.

Due to privacy regulations, this feature would not be available in Europe or Canada, the firm said at the time.
