The Justice Department is reviewing a recommendation that it fire former FBI Deputy Director Andrew McCabe, days ahead of his scheduled retirement, amid an inspector general investigation expected to be harshly critical of him, a person familiar with the matter said Wednesday.

Mr. McCabe is the focus of an internal Department of Justice probe on the FBI's investigation over decisions made during the 2016 presidential campaign, including Hillary Clinton's use of a private email server.

The person said McCabe is suspected of misleading internal investigators about a media leak, an allegation he denies.

"The Department follows a prescribed process by which an employee may be terminated", Justice Department spokesperson Sarah Isgur Flores said in a statement.

McCabe took a leave of absence in January following reports that President Donald Trump and Sessions tried to pressure FBI Director Chris Wray to fire McCabe. If the Justice Department does not move on the recommendation, conservatives might view officials there as unfairly protecting McCabe. The inspector general's report, which led to the recommendation from the disciplinary office, has not been released but is expected out soon.

"FBI Deputy Director Andrew McCabe is racing the clock to retire with full benefits", Trump tweeted in December.


The situation now seems fraught for all involved.

Firing McCabe, who has worked at the Federal Bureau of Investigation for the past 22 years, before his retirement would cause him to lose his pension.

Trump has previously suggested McCabe was biased in favor of Clinton, pointing out that McCabe's wife, who ran as a Democrat for a seat in the Virginia Legislature, received hundreds of thousands of dollars in donations from the political-action committee of Terry McAuliffe, the then-governor of Virginia and a noted Clinton ally.

Trump has pressured Attorney General Jeff Sessions ― another frequent target of Trump's wrath ― to get rid of McCabe.

His departure followed months of attacks from Mr Trump, who has lambasted the Department of Justice and the Federal Bureau of Investigation as compromised by the presence of partisan officials.

"Why didn't A.G. Sessions replace Acting FBI Director Andrew McCabe, a Comey friend who was in charge of Clinton investigation", the president demanded to know last June.
