"Cowardly" Fox News & Bill O'Reilly Sued By Sexually Harassed Ex-Producer

Berstein's attorney filed a lawsuit in the U.S. District Court for the Southern District of NY against O'Reilly and Fox News for breach of contract and defamation. Fox News also released a statement in response to the April 1 story, reiterating a claim by O'Reilly that "no one has ever filed a complaint about me" with the company's human resources department.
Bernstein alleges that O'Reilly had defended the payouts in the New York Times and other publications by portraying her as a "liar and politically motivated extortionist".
Bernstein complained in 2002 that she was mistreated by O'Reilly when she worked for the network, and ultimately reached a settlement agreement with the network.
According to the suit, the settlement agreement provided that the parties would not disparage each other and that, if asked, the parties would say that "the matter has been resolved".
She says O'Reilly insinuated she extorted him which she says is a lie, calling the former FNC host a "serial abuser".
Since Fox News cut ties with O'Reilly-just weeks after the Timespublished an April report detailing the numerous settlements O'Reilly and 21st Century Fox made regarding sexual harassment-he's taken numerous occasions to question the credibility of the anonymous women and reiterate his total innocence. "The worst part of my job is being a target for those who would harm me and my employer, the Fox News Channel". According to Bernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment. She did go to HR and other company executives to complain about him several times. "There is ample evidence that Fox News, with the complicity of top executives, enabled the abuse of women for many years then silenced them with non-disclosure agreements and non-disparagement clauses".
Neither reps for FNC nor O'Reilly replied to request for comment on the suit. In it, Bernstein was personally identified as a "young producer" who, in 2002, was allegedly verbally assaulted by O'Reilly in the Fox newsroom.
"Defendants Fox and O'Reilly materially breached the Agreement by making statements other than the agreed-upon statement and by issuing false, disparaging and defamatory statements", the 14-page jury trial seeking four count complaint asserts.
