Supreme Court pulls up West Bengal for plea against Aadhaar-benefits linking

Earlier, the deadline for linking of Aadhaar was December end this year.

A Constitution Bench of the Supreme Court will hear the Aadhaar matter in November.

"How can a State challenge a law passed by the Center?"

"Under no circumstances will I link my Aadhaar with my telephone number. I will not link my Aadhaar number with my mobile even if my connection is snapped", she said at a party meeting.

In the last hearing of the matter on October 25, the Centre had indicated that the deadline for linking Aadhaar with bank accounts, PAN, mobile numbers and other schemes for those who don't have the unique identification number and are willing to go for it may be extended till March 31.

West Bengal Chief Minister Mamata Banerjee fell short of gaining a political brownie, as Supreme Court snubbed West Bengal government on challenging Parliament's mandate.


The court also issued notices to the telecom companies insisting on the mandatory linking of mobile with Aadhaar. The Supreme Court came down hard on the Mamata Banerjee government for filing a plea challenging the Centre's move to make Aadhaar mandatory for availing benefits of social welfare schemes, saying it was against the federal structure.

A two-judge bench, headed by justice A.K.Sikri, pulled up the state government and said that it should limit the scope of challenge to a specific issue that needs to be addressed. The court, however, asked the West Bengal counsel to amend its prayer and submit a fresh plea. "The municipalities will have to battle this situation", Banerjee said at a press conference.

The Bench expressed its annoyance, observing "let an individual come to us".

A Bench led by Chief Justice of India Dipak Misra in the morning agreed to the Center's plea to hear the government later in the day on the question whether linking of bank accounts and mobile phones with Aadhaar would be made voluntary till March 31.

Banerjee had previously said that the state is keeping an eye on how the diagnostic centres and pathological laboratories are handling the dengue crisis.
