In the same vein, the Federal high court also proscribed the group on the request of the Nigerian government, a verdict which is being challenged by the group.

He said Kanu had "crossed a line" with his agitation for Biafra and that he (Mohammed) suspects the IPOB leader could be "in hiding".

The whereabouts of Kanu, his father and his mother during and after the invasion has remained unknown, Ejiofor claimed in the summons.

Kanu is now on bail pending the resumption of his trial in Abuja next month on charges of treasonable felony. IPOB maintains that the group is non-violent.

The Presidency on Sunday said that it has facts to show that IPOB was registered in the State of California in United States of America.


This, the suit stated was because, Kanu was last seen after soldiers, on September 14, invaded the IPOB leaders house in Afara-ukwu Ibeku, Umuahia Abia State, "on a murderous raid, where life and mortar bullets were fired on unarmed and defenseless populace, leaving 28 persons dead and abducting many".

The senate on Tuesday declared that Nigeria's unity is not negotiable. Human rights groups have reported that the army's highhandedness has led to death of scores of IPOB members.

However, after Saraki's comments, the Federal Government of Nigeria had immediately taken its quest for IPOB's proscription to court where it obtained a court's order proscribing IPOB.

Meanwhile, Kanu through his lawyer in the suit filed before the court is praying it to make an order compelling the Chief of Army staff to produce him (Kanu) in court on the next adjourned date to enable him defend himself in the terrorism charges slammed against him by the Federal government.

But IPOB had equally approached the court, demanding it to quash the order, saying the court order that said it was a terrorist organisation was a black market order.
