Kenya opposition party: No repeat election unless demands are met

Kenyatta said the Supreme Court decision to nullify his presidential election win was the most painful moment of his life.

The judges said the failure by the IEBC to provide access to its servers and logs, denied petitioners and the court a chance to verify information in the IEBC servers, hence their determination that the election was bungled.

Deputy Chief Justice Philomena Mwilu read the majority judgment said the Supreme Court judges concluded that the IEBC election transmission system was compromised and data interfered with.

The IEBC declared incumbent President Uhuru Kenyatta, the victor of August's election by 54% to 45%.

Kenya has the region's richest economy and is a key Western ally in a region often shaken by violence.

"Now is the time to focus on preparing for the new poll, which, in line with the court's order and the constitution, must be run by the Independent Electoral and Boundaries Commission and be held by the end of October", they said in a joint statement.

Wednesday's detailed ruling, plus opposition demands for an overhaul of the commission and warnings from the French firm that provided digital voting kits that it will not be ready on time, have raised fears it will be impossible to meet the poll deadline.


Makueni Senator Mutula Kilonzo Junior has given his early breakdown of the Supreme Court full judgment, predicting a possible jail term for two of the IEBC officials Wafula Chebukati and Ezra Chiloba for contempt of court and violation of the Election offence act.

Mr. Maraga further condemned what he described as attacks on Kenya's judicial officers and staff, saying "these attacks are denigrating, demeaning and degrading and are meant to intimidate, threaten and cow the institution and individual judges". "These discrepancies affected the integrity of the elections", Chief Justice David Maraga said. "The [board] can not therefore be said to have verified the results", she noted.

The roads around Kenya's Supreme Court were cordoned off Wednesday, and police dispersed protesters from the ruling and opposition parties who had gathered outside.

About 10,000 paper forms from polling stations, each containing the documentation of anywhere from dozens to hundreds of votes, were missing when the results were announced.

He said that until that was achieved, he and his colleagues were prepared to pay "the ultimate price" to safeguard the rule of law. Maraga said the opposition had failed to show evidence Kenyatta had campaigned using state resources or undue influence.

The commission also accused police of not providing sufficient protection for the judiciary.
