Lawmakers Outline Potential Perjury Case Against Clinton in Letter to US Attorney

Furious the FBI didn't press charges against their political rival, Republicans now are demanding that the Justice Department open a new investigation into whether Clinton lied during testimony previous year before the House Benghazi panel.

The FBI last month closed its yearlong probe into whether Clinton and her aides mishandled sensitive information that flowed through a private email server located in the basement of her NY home. The files include material that is "non-public", containing "classified and other sensitive" information.

The FBI sent to Congress Tuesday a report the bureau provided to the Justice Department last month to explain why it recommended no charges in the Hillary Clinton email server investigation, according to United States officials briefed on the matter.

The lawmakers asked Comey to provide an explanation of why the interview wasn't transcribed, as well as copies of interviewing agents' notes. Polls show Mrs. Clinton with a widening lead over Republican challenger Donald Trump. State Department spokesman John Kirby added that two of those three emails were mistakenly marked as confidential.

Separately, two House Republicans sent a letter Monday to the USA attorney in Washington, listing statements she made in congressional hearings about the e-mail issue while she was secretary of state. Rep.

"A very small number of the emails containing classified information bore the markings indicating the presence of classified information", he said.

The notes from Hillary Clinton's interview with the Federal Bureau of Investigation over her private email server may be delivered to Congress as soon as Monday, according to a report Sunday by CNN.

"The FBI already determined unanimously that there is insufficient evidence of criminal wrongdoing", Cummins said in a statement.

"The entire interview ... was focused on, 'So, what did you know, what did you see, what is this document, ' that kind of thing", he told the House Oversight and Government Reform Committee.

The GOP-led committees have not provided details about the full contents of the FBI's submission to Congress.

Politico first reported that the Obama administration was debating how to release the documents, over concern that the records are politically sensitive.

The former secretary of state has argued Comey confirmed during his hearing the truthfulness of her public statements about the emails, although Comey merely said Clinton's public words matched her private ones. "My understanding is that we have not received them".
